State Laws Applicable to the Payday Loan Industry:
Payday lending in Wyoming is regulated by the Wyoming Division of Banking. Lenders are required to be licensed with the state in order to issue check advance or payday loans to the public. Cash advance businesses are also required to clearly display all conditions surrounding the loan agreement including loan fees and loan terms. Consumers are given the option to cancel their payday loans within a 20 day period, in which time the lender must issue a full refund. Wyoming law allows borrowers to obtain a payday loan for a period up to 30 days; however, there is no cap placed on the amount that borrowers can obtain in payday loans funds. Wyoming law also does not specify the amount of payday advance loans a borrower can obtain at once. The APR (annual percentage rate) applied to a $100 loan issued for a 2-week period would be 780%, which is quite high even for the cash advance loan industry. It is advised that borrowers carefully calculate the overall costs of their payday loan, taking into account all additional fees and charges, before entering into a payday loan contract.
